Terms of Service

1. Definitions

"Prettie" or "Platform" refers to Prettie SRL, a company registered in Bucharest, Romania, which owns and operates the Prettie online marketplace accessible via web and mobile applications.
"Business" or "Service Provider" refers to any beauty, wellness, or aesthetic professional, salon, clinic, or practitioner listed on the Prettie platform who offers services to clients.
"Client," "You," or "Your" refers to any individual who accesses or uses the Prettie platform to discover, browse, book, or pay for services, whether as a registered user or a guest.
"Services" refers to beauty, wellness, aesthetic, and medical-aesthetic treatments, procedures, and appointments booked through the Prettie platform.

2. Acceptance of Terms

By accessing, browsing, or using the Prettie platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree to any part of these terms, you must not access or use the platform. For registered users, acceptance of these terms is confirmed at the time of account creation. Continued use of the platform after any modification to these terms constitutes your acceptance of the revised terms.

3. Description of Service

Prettie is an online marketplace that connects clients with beauty, wellness, and aesthetic service providers across Europe. Our platform facilitates:

Discovery and search of businesses and service providers
Online booking and appointment scheduling
Secure payment processing
Reviews and ratings
Communication between clients and businesses

Important: Prettie is NOT the provider of the underlying beauty, wellness, or medical-aesthetic services. We are a technology platform that facilitates the connection between you and independent service providers. The contract for any services you book is formed directly between you and the business you book with. Prettie acts solely as an intermediary.

4. Account Registration

To access certain features of the platform, you may create a personal account. By registering, you agree to the following:

You may create an account using your email address or through social login providers, including Google, Apple, Microsoft, and Facebook.
You must provide accurate, current, and complete information during registration and keep your profile information up to date.
You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password.
You must notify Prettie immediately at support@prettie.com if you become aware of any unauthorized access to or use of your account.
You are responsible for all activities that occur under your account, whether or not authorized by you.
Each individual may hold only one personal account on the platform.
You must be at least 16 years of age to create an account. If you are under 18, you confirm that you have parental or guardian consent.
Prettie reserves the right to refuse registration, or to suspend or terminate any account at its sole discretion, including for violation of these terms, suspected fraud, or inactivity.

5. Guest Bookings

You may book certain services on the platform without creating a registered account, subject to the following conditions:

Guest bookings require you to provide your name, email address, and optionally a phone number.
Personal data collected for guest bookings is retained for the duration specified in our Privacy Policy and in accordance with applicable data protection laws.
Certain features of the platform, including submitting reviews, participating in loyalty programs, accessing booking history, and saving favorite businesses, are available only to registered users.
Guest users may convert to registered users at any time by completing the registration process.

6. Bookings and Appointments

When you make a booking through the Prettie platform, the following terms apply:

By booking a service, you enter into a direct agreement with the service provider. Prettie is not a party to that agreement.
Booking confirmation is subject to the business's availability and acceptance. Until you receive a confirmation, no binding appointment has been established.
You agree to arrive on time for your scheduled appointments. Late arrivals may result in shortened service time or cancellation at the business's discretion.
Cancellation policies are set by individual businesses and are clearly displayed at the time of booking. By completing a booking, you agree to the applicable cancellation policy.
No-show policies and associated fees are determined by the business. Repeated no-shows may result in restrictions on your ability to book through the platform.
Prettie is not responsible for the quality, safety, suitability, or outcome of services provided by businesses listed on the platform.
Businesses may require a deposit or full prepayment at the time of booking. Deposit and prepayment terms are displayed before you confirm your booking.

7. Payments

All financial transactions on the Prettie platform are subject to the following terms:

Payments are processed by Stripe, a PCI-DSS Level 1 certified payment processor. Prettie does not store your full payment card details on its servers.
By making a payment, you authorize the charge to your selected payment method for the amount specified at checkout.
Prices for services are set by businesses and are displayed inclusive of applicable taxes unless otherwise stated.
Payment timing varies by business and may include: payment at the location after service, a deposit at the time of booking with the balance due at the appointment, or full prepayment at the time of booking.
Tips and gratuities are entirely voluntary and, where supported, are processed through the platform.
Refunds are handled in accordance with the business's cancellation policy and applicable consumer protection laws. Refund processing times depend on your payment provider.

Gift Cards

Gift cards purchased through the Prettie platform are non-refundable unless otherwise required by applicable law.
Gift cards may have an expiry date, which is clearly displayed at the time of purchase. Expired gift cards cannot be redeemed or extended.
Gift cards are redeemable only on the Prettie platform and cannot be exchanged for cash, transferred to other platforms, or applied outside of the Prettie ecosystem.

8. Reviews and User Content

Prettie enables registered users to share their experiences through reviews. The following terms govern user-submitted content:

You may submit reviews only for services you have actually received through verified bookings on the platform.
Reviews must be honest, accurate, and based on your genuine personal experience with the service and provider.
By submitting a review or any other content (including photos), you grant Prettie a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute your content on the platform and in marketing materials.

Prohibited Content

The following types of content are strictly prohibited and will be removed:

Defamatory, discriminatory, threatening, or harassing language
False, misleading, or fabricated statements
Content that infringes upon or violates third-party intellectual property or privacy rights
Spam, advertisements, or promotional content
Content unrelated to the service received
Personally identifiable information of other individuals without their consent

Prettie reserves the right to review, edit, or remove any content that violates these guidelines, at our sole discretion and without prior notice. Businesses may respond to your reviews publicly through the platform.

9. Medical and Aesthetic Services Disclaimer

This section contains important information about medical and aesthetic services available through the platform. Please read it carefully.

Prettie is NOT a healthcare provider, medical practice, clinical facility, or regulated health institution. Prettie does not employ, supervise, or direct the medical or aesthetic professionals listed on the platform.
Medical-aesthetic and aesthetic services — including but not limited to dermal fillers, botulinum toxin injections, laser treatments, chemical peels, microneedling, body sculpting, permanent makeup, and tattoo procedures — are provided exclusively by independently licensed professionals operating at the businesses listed on our platform.
Prettie provides only the digital infrastructure for booking, scheduling, record keeping, and payment processing. We do not perform, direct, or oversee any clinical or aesthetic procedures.
Consent forms for medical or aesthetic procedures are agreements between you and the treating practitioner. While Prettie may facilitate the digital creation, delivery, and storage of such forms, Prettie is not a party to the consent and bears no clinical responsibility.
Clinical records — including SOAP notes, treatment plans, prescriptions, and before-and-after photographs — are created and managed by your treating practitioner using tools provided by our platform. Prettie is a data processor, not the data controller, for clinical records.
You are responsible for providing accurate and complete medical history, including allergies, medications, pre-existing conditions, and prior treatments, to your service provider before any procedure.
Prettie does not provide medical advice, diagnose medical or aesthetic conditions, or recommend specific treatments or procedures. Information displayed on the platform is for general informational purposes only.
Always consult with a qualified and licensed healthcare professional about the suitability, risks, and expected outcomes of any procedure before proceeding.
Prettie is not liable for any adverse outcomes, complications, injuries, or dissatisfaction arising from services received through the platform. All liability for the provision of services rests with the treating practitioner and their business.

10. Loyalty Programs, Memberships, and Gift Cards

The Prettie platform enables businesses to offer various loyalty and membership programs. The following terms apply:

Loyalty programs, including points-based systems and digital stamp cards, are operated by individual businesses through the platform. Program rules, earning rates, and redemption terms are set by the participating business.
Points, stamps, and rewards are specific to the issuing business and have no cash value. They cannot be transferred between businesses or exchanged for money.
Membership programs, including their terms, pricing, benefits, and duration, are set and managed by individual businesses. Membership terms are presented to you before purchase.
Referral bonuses and promotional credits are subject to specific program terms, which may be modified, suspended, or discontinued by Prettie or the participating business at any time.
Prettie may operate its own platform-wide promotions, discounts, or loyalty initiatives from time to time. Such promotions are subject to specific terms and conditions published at the time of the promotion.

11. Intellectual Property

The Prettie platform, including its design, user interface, software, source code, algorithms, logos, trademarks, and all original content, is the intellectual property of Prettie SRL and is protected by applicable copyright, trademark, and intellectual property laws.
You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or create derivative works of any part of the platform without prior written consent from Prettie SRL.
Business listings, photographs, descriptions, and branding materials displayed on the platform are the property of the respective businesses and are used with their authorization.
Your submitted content, including reviews and photographs, remains your intellectual property, subject to the license granted to Prettie under Section 8 of these terms.

12. Prohibited Conduct

You agree not to engage in any of the following activities when using the Prettie platform:

Creating false, misleading, or fraudulent accounts, or providing inaccurate information during registration
Booking services you do not intend to use, including making repeated speculative or phantom bookings
Harassing, threatening, intimidating, or abusing businesses, service providers, or other users of the platform
Attempting to circumvent the platform to contact businesses directly in order to avoid applicable fees or commissions
Scraping, harvesting, crawling, or collecting data from the platform by automated means or otherwise
Interfering with or disrupting the platform's operation, security, or infrastructure, including introducing viruses, malware, or other harmful code
Using the platform for any unlawful, fraudulent, or unauthorized purpose
Impersonating another person, entity, or Prettie representative
Submitting fake reviews, manipulating ratings, or engaging in any form of review fraud
Using the platform to promote competing services or for unauthorized commercial purposes

Violation of any of the above may result in immediate suspension or termination of your account, removal of your content, and, where appropriate, referral to law enforcement authorities.

13. Limitation of Liability

Prettie operates as a marketplace platform connecting clients with independent service providers. To the fullest extent permitted by applicable law:

Prettie is not liable for the quality, safety, legality, or suitability of services provided by businesses listed on the platform.
Prettie is not liable for any medical or aesthetic outcomes, complications, or adverse effects resulting from services booked through the platform.
Prettie is not liable for disputes, disagreements, or claims that arise between you and any service provider.
Prettie is not liable for loss of data, interruptions to service, or system unavailability beyond our reasonable control.
Prettie is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, beyond those required by applicable law.

To the maximum extent permitted by law, Prettie's total aggregate liability to you for any and all claims arising out of or related to your use of the platform shall not exceed the total amount you have paid through the platform in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these terms limits or excludes your statutory rights as a consumer under European Union law or the laws of your country of residence. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

14. Indemnification

You agree to indemnify, defend, and hold harmless Prettie SRL, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms of Service; (b) your use or misuse of the platform; (c) content you submit, post, or transmit through the platform; (d) your violation of any applicable law or regulation; or (e) your infringement of any third-party rights.

15. Termination

Either you or Prettie may terminate your account under the following conditions:

You may delete your account at any time through your profile settings or by contacting our support team at support@prettie.com.
Prettie may suspend or terminate your account at any time if you violate these Terms of Service, engage in prohibited conduct, or if we reasonably believe your account poses a risk to the platform or other users.
Upon termination of your account: your booking history is retained in accordance with our data retention policy and applicable legal requirements; reviews you have submitted are anonymized; and your personal data is deleted in accordance with our Privacy Policy and applicable data protection laws.
Termination does not affect any rights or obligations that accrued prior to termination, including pending bookings, outstanding payments, or unresolved disputes.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Romania.

Without prejudice to the mandatory consumer protection provisions of your country of habitual residence that apply under EU Regulation 593/2008 (Rome I Regulation), which cannot be derogated from by agreement.

You retain any and all rights granted to you by the consumer protection laws of your country of habitual residence that cannot be waived, restricted, or excluded by contract.

17. Dispute Resolution

We are committed to resolving disputes fairly and efficiently. In the event of a disagreement:

We encourage you to contact us first at legal@prettie.com so that we can attempt to resolve the matter directly and amicably.
For consumers residing in the European Union: you may use the EU Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr, to submit your complaint to an approved alternative dispute resolution body.
You retain the right to bring legal proceedings in the competent courts of your country of habitual residence, in accordance with applicable EU consumer protection regulations.

18. General Provisions

Severability: If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement: These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Prettie with respect to your use of the platform. They supersede all prior agreements, understandings, and representations, whether written or oral.
No Waiver: Our failure or delay in exercising or enforcing any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Prettie.
Assignment: Prettie may assign, transfer, or delegate its rights and obligations under these terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, without your prior consent. You may not assign or transfer your rights or obligations without our written consent.
Modifications: Prettie reserves the right to modify these Terms of Service at any time. Material changes will be communicated to registered users via email or through a prominent notice on the platform. Your continued use of the platform after such notification constitutes acceptance of the modified terms.
